Closed loop control systems enable continuous monitoring of a patient's physiological condition and automatically adjusts treatment in response to real-time feedback. This adaptive approach supports more personalised and responsive disease management.
Current closed loop diabetes systems combine hardware, software, algorithms, data and user interfaces, each of which may require a different form of intellectual property protection. This is where an IP layering strategy becomes particularly valuable. With IP layering, rather than relying on a single patent, multiple forms of IP protection are used to protect different aspects of the product, making it much more difficult for competitors to work around the technology.
In a closed loop diabetes system, patents may protect the hardware such as the sensor and the pump, while copyright protects software code, trademarks protect the product name and branding, industrial designs protect the appearance of the device, and trade secrets protect confidential know-how. By combining these protections, a company creates overlapping barriers that make it more difficult for competitors to copy the product or design around a single IP right.
IP layering requires careful consideration of how different forms of intellectual property can work together to protect a technology. Key considerations include finding the right balance between patent protection and trade secret protection, managing the costs and complexity of maintaining multiple IP rights across different jurisdictions and ensuring clear ownership of IP assets to list a few.
An effective IP layering strategy helps maximise the value of innovation while creating market entry barriers for competitors.
