Our firm was founded in the city of Birmingham in 1887. Over the last century and a quarter, our European and UK Patent and Trade Mark Attorneys have developed particular strength in protecting innovation produced by the industries present across the Midlands, including automotive, life sciences, chemical, electrical, food and drink, manufacturing, and mechanical.

Since its founding, the office has expanded to provide specialist intellectual property services to support businesses of all sizes, from blue-chip companies to SMEs to entrepreneurs. Our team has the skills and experience to support specific commercial needs of all types of commercial organisation.

Our Birmingham office has outstanding links with the universities and other academic institutions in the region. Bridging the gap between academic and commercial, our patent attorneys advise inventors, guide spin-outs and assist tech transfer departments to maximise the value of their IP.

In addition to offering patent, trade mark and design right protection services, our attorneys and lawyers (solicitors) can advise on IP-related licensing, due diligence and contracts.

We are proud to be an active member of the Birmingham Chamber of Commerce, and are always keen to support local businesses, both in the UK, and more broadly through our international network of Marks & Clerk offices.

Members of staff in our Birmingham office are keenly involved in CSR activities, such as Envision’s Community-Apprentice competition.

The office is located in the heart of Birmingham city centre, opposite the new Library of Birmingham, and is easily accessible with national and international transport links.

As we reported in early 2022, the Enlarged Board of Appeal of the EPO are considering two pending referrals (G1/22 and G2/22) regarding the question of entitlement to priority. A hearing has now been set for 26 May 2023, and the Enlarged Board have now issued a preliminary opinion setting out the points to be discussed.

On 16 March 2023, Mr Justice Mellor handed down the latest FRAND judgment: InterDigital v Lenovo. The case concerned a dispute between InterDigital and Lenovo as to the terms on which Lenovo should take a licence to InterDigital’s portfolio of patents which had been declared essential to the European Telecommunications Standard Institute (ETSI) Standards.
