Luxury floral company Flowerbx Ltd has successfully defended its trade mark rights in a High Court dispute against a competing business operating under names including Flowers Box and Flowers Box London.
The decision highlights the value a strong reputation can provide when enforcing trade mark rights, but also the importance of being able to evidence that reputation. Flowerbx relied on evidence including its turnover, advertising, social media engagement, high-profile collaborations and media coverage, alongside examples of actual consumer confusion.
