Phil Merchant, patent attorney and Space Technologies lead has been featured in Solicitors Journal commenting on reports that Elon Musk is considering a potential merger between Tesla and SpaceX.
Phil highlighted the contrast between the companies' IP strategies. While Tesla has taken a more open approach to patents since its 2014 "Patent Pledge", SpaceX has traditionally relied on trade secrets to protect its core technologies.
Phil notes that combining the technological expertise of both businesses could create significant opportunities, but that their differing approaches to IP protection may present interesting challenges as technologies become increasingly interconnected. He says that it will be fascinating to see which philosophy ultimately shapes the direction of any merged entity.
