As Malaysia transforms from a manufacturing economy to a knowledge economy, protection of innovation is key to success.
Malaysia is a multi-ethnic and multi-cultural country which has a legal system similar to the UK. In addition, the country is rich in resources such as palm oil, rubber and petroleum, and has become a manufacturing hub for electronics and consumer goods, with major government initiatives supporting biotechnology and information technology. Malaysia is also a leading destination for bio-prospecting due to its ecological diversity, with one of the highest numbers of endemic species in the world.
Malaysia receives a significant amount of foreign direct investment and is the centre of the oil and gas industry for Southeast Asia, where many oil majors have established their regional offices.
In light of the potential for innovation, rapid economic progress and the open business environment, Marks & Clerk established an office in Kuala Lumpur in 2009, and is now based in the same building as the Malaysian Intellectual Property Office.
Our Kuala Lumpur office handles all areas of intellectual property but has particular strengths in life sciences, information technology, and electronics. We also have a highly experienced trade mark team whose attorneys advise household names across the world on brand protection and exploitation. Our staff are reflective of the cultural diversity of the country with over 10 languages and dialects being spoken.
In Managing IP’s IP Stars guide and Asia Legal Business’s industry rankings, we are ranked in Tier 1 for patent work in Malaysia. We also won the 2016 Asia IP award in the ‘Malaysia Patents’ category. According to IAM Patent 1000 2016, we are a “potent presence in the Malaysian prosecution space.” One commentator noted that “Malaysian companies are thrilled to have a firm with international standards like Marks & Clerk. In the past, much of that work would have been sent off to Australia or Singapore.” A commentator in the 2016 edition of World Trademark Review 1000 noted of our Malaysia business that “Brand owners need both local and global vision and advice, and Marks & Clerk can deliver.”
