Xuefang serves as Partner, Head of the Trade Mark team and Legal Representative at Marks & Clerk Beijing. With over 20 years' experience advising clients on all aspects of Chinese IP law, her practice spans the full spectrum of trade mark and copyright law, including portfolio management, dispute resolution, customs enforcement actions, IP due diligence, anti-counterfeiting strategies, cybersquatting disputes, unfair competition litigation, and transactional IP matters. Her practice also extends to advising clients on cross-border brand protection strategies across multiple jurisdictions. She has represented clients from diverse industries, with particular expertise in automotive, food and beverages, pet food, sports gear, entertainment, digital finance and e-commerce platforms.
Some of Xuefang's career highlights include securing well-known trade mark status in China for three marks belonging to a globally renowned luxury automotive manufacturer. In addition to successfully opposing several hundred infringing trade marks for this automotive brand, she persuaded the CNIPA to proactively reject over 200 malicious marks filed by third parties, secured the first administrative penalty issued by Administration for Market Regulation in Beijing against dishonest trade mark agencies, and removed three-decade-old bad-faith registrations through litigation. She currently leads serial trade mark infringement and unfair competition lawsuits for this automotive client against infringers. Previously, she successfully defended a US pet food company against series infringement lawsuits despite its unregistered trade mark status in China, subsequently invalidating the squatter's trade marks through CNIPA actions and follow-up court proceedings.
Xuefang is recognised for her thorough strategic planning, evidence-gathering capabilities, and proactive collaboration with regulatory authorities and third-party platforms to support clients. Several of her cases have withstood Supreme People's Court retrial scrutiny.
Xuefang has been admitted to practice law in China since 2004 and in the State of New York since 2012. She actively contributes to IP policy and practice development through her former role as Co-Chair of the INTA Bulletins Committee - China Subcommittee (2022-2023) and current position as Co-Vice Chair of the AIPPI China Trademark Committee. She regularly engages with government agencies, legal professionals and academics to advance trade mark practices. She frequently publishes articles on developments in Chinese trade mark and copyright law.
