Overview & Expertise

Kirsten Gilbert is a Partner and Head of Brand Exploitation, Protection and Trade Mark Litigation UK at Marks & Clerk Law, based in London. She advises clients on the development, protection and exploitation of brand assets across the full IP lifecycle, with particular focus on trade marks and related rights.

Kirsten has extensive experience in helping brands to navigate through the challenges and opportunities presented by developing, protecting and exploiting brand assets in the context of their business. With many years experience working as a trusted advisor to a diverse range of clients Kirsten with all aspects of the branding life cycle Kirsten has represented clients in enforcing their registered and unregistered trade marks in infringement proceedings in the IPEC and High Courts including applications for preliminary injunctions. In addition, Kirsten has worked across jurisdictions to put in place anti-counterfeiting strategies.

In addition, Kirsten advises on the drafting, negotiation and execution of complex commercial agreements relating to all intellectual property rights including complex trade mark licensing agreements for high value collaborations and branded residences and all aspects of due diligence for transactions with significant IP focus. She also supports clients on assessing the strength of the IP portfolio both prior to sale or refinancing and after acquisition.

Kirsten is a Solicitor qualified in England & Wales. She holds a Diploma in Intellectual Property Law from the University of Bristol and an LLB (Hons) from the University of Sheffield.
