IP disputes in China

For nearly 40 years, we have been solving our clients’ intellectual property disputes in China

In that period the intellectual property regime in China has changed beyond recognition and China is now one of the most important jurisdictions in the world for IP enforcement.

Our dedicated China Disputes team comprises attorneys and lawyers, each with years of experience of Chinese IP litigation. Our experience covers technologically complex patent disputes, brand protection matters, and design and copyright infringements.

We serve as a litigation bridge between western clients and Chinese lawyers

Our attorneys in China regularly appear in Chinese courts alongside Chinese lawyers to advocate for our clients. Furthermore, they are also directly involved in administrative proceedings as is frequently demonstrated by our busy Beijing office, which has a very strong track record in contentious trade mark administrative cases, with a high success rate.

Many of our China-based attorneys are dual qualified in China and western jurisdictions and all are bilingual. Our wider, global China disputes team, based in the UK and Mainland Europe, offer litigation expertise that covers the coordination of Chinese proceedings, often as part of multi-jurisdictional IP disputes, as well as advising clients on the very different approach that is required to the initiation and conduct of litigation in China, compared with other leading jurisdictions.

In June 2021, the Beijing Xicheng District Administration of Market Regulation issued a warning and imposed a fine of RMB 70,000 on Beijing Sihailong Intellectual Property Agency Limited for filing applications for a Hong Kong copycat company that “shared” the same Chinese name as Bentley Motors Limited.
