Gregor is an experienced hands-on patent litigator and Of Counsel at Marks & Clerk Law.

“Gregor Grant is called upon for his expertise in patent litigation. He has achieved successful outcomes for clients in cases concerned with life sciences, hi-tech and mechanical engineering technologies.”
(Chambers & Partners)

With over 50 years’ experience in intellectual property law, Gregor is a “renowned litigator” (IAM Patent 1000) and has been “one of the leading lights in patent litigation for many years" (Chambers & Partners). He adds a wealth of knowledge and invaluable expertise to the firm’s patent litigation team, playing an active role in advising clients across all sectors.

His interest in patents stems from tinkering with bicycles and motorcycle engines. An early interest in all things mechanical branched out into life sciences and all fields of technologies, and other IP rights including copyright and designs.

Gregor has handled cases that include those in the fields of clinical diagnostics, stents and implants, pharmaceuticals and therapeutic antibodies, hydraulic lifting machines, high pressure valves, machine tools, food technology, food packaging, computer systems and electric motors. Many of these have had a multi-jurisdictional aspect.

Pursuing a career in IP rescued Gregor from an alternative career as an impoverished blues pianist. The music has not been forgotten...He plays keyboard in Marks & Clerk Law’s rock band "The Defendants”.

Can there be an interim injunction before a patent is granted?

A patentee can bring an action for infringement only once the patent has been granted.  The claim need not be restricted to acts committed after grant.  It can extend to acts which were committed before the grant but after the date of publication of the patent application.

Kwikbolt v Airbus: Applying the “inventive concept” to the doctrine of equivalents - Headnote by Gregor Grant – Marks & Clerk Law LLP

Further to the UK Supreme Court introducing a doctrine of equivalents into UK patent law in the summer of 2017 (see http://eplaw.org/uk-actavis-v-eli-lilly-supreme-court/), the UK courts are gradually coming to terms with the various approaches that have to be applied in deciding whether to apply the doctrine in the absence of “literal” infringement of a claim.
