Gina Lodge

Gina is an intellectual property lawyer who advises clients on all aspects of intellectual property law, with a particular focus on trade marks, passing off, designs and copyright. Gina has a leading role within Marks & Clerk Law’s trade mark, copyright and designs practice.
The majority of Gina’s practice is contentious work and she has represented clients from a wide range of sectors in disputes before the High Court and Intellectual Property Enterprise Court, including recently acting for BG Electrical in High Court proceedings concerning 4 registered designs and 23 unregistered design rights subsisting in wiring accessory products. Gina has also been involved in multi-faceted trade mark cancellation proceedings before the UKIPO (with the associated threat of subsequent summary judgment for infringement pursuant to the Firecraft decision) and with trade mark appeals before EU IPO and the General Court of the European Union. Gina also has experience of EU customs detention strategies.
In addition, Gina has significant experience in providing commercial,  strategic and creative advice to clients at the pre-action stage and is skilled in negotiating great results for her clients without the need for litigation (the avoidance of, or extrication from, litigation often being a stated objective). As a result of the breadth of her practice, Gina has acquired a good understanding of the intellectual property issues facing clients across multiple sectors and is able to provide clear, commercial advice on the scope and limitations of her clients’ rights – and the best way to protect and enforce those rights accordingly.

Gina also has considerable patent experience, having been involved in a number of multi-jurisdictional patent disputes for clients across a broad range of sectors including pharmaceuticals and medical devices, manufacturing and TMT and electronics, including major multi-national litigation for US and European technology clients encompassing software and systems governing media recommendation engines and septal occluders.
On the non-contentious side, Gina has advised on intellectual property aspects of corporate transactions, intellectual property licensing and the securitisation of intellectual property rights. For instance, Gina recently advised on a design services agreement between a major car manufacturer and a top British designer.
