Vicky Butterworth

Vicky is an intellectual property lawyer. She advises clients on the protection, management and enforcement of intellectual property rights, in particular, trade marks, copyright and designs.

She has extensive experience of conducting litigation in the UK relating to trade marks, copyright, database rights, designs, patents and confidential information both in the High Court and Intellectual Property Enterprise Court (IPEC) and on appeal to the Court of Appeal. She has direct experience of conducting damages inquiries and account of profits claims in the High Court and IPEC following trial on the issue of liability. Vicky has also advised on proceedings before the UK Intellectual Property Office.

Vicky has significant experience of alternative dispute resolution. She has been involved in a number of successful mediations in relation to disputes involving trade marks and designs.

Vicky advises clients in relation to Internet issues, such as those involving domain names and keywords, and has conducted proceedings before ICANN and Nominet. She also advises on advertising issues including complaints to the Advertising Standards Authority.

She is regularly called upon to advise clients on IP strategy and on disputes or potential disputes at a very early stage with a view to achieving a mutually satisfactory commercial resolution without the need for litigation. Vicky also regularly advises on commercial IP matters, including portfolio management, licensing and coexistence agreements.

She works with a wide range of clients from large multinational rights holders to SMEs across many sectors including media and entertainment, fashion, retail, sports, leisure and technology. She has advised on disputes relating to, for example, parallel imports, TV formats, databases, music, fabric and clothing designs, "get-up" of products (eg shape, colour and slogans) and methods for intercepting mobile telecommunications.

Vicky is a Solicitor Advocate having been awarded Higher Rights of Audience. She is an associate of the Chartered Institute of Trade Mark Attorneys and a member of Marques. Vicky is also on the IP Consulting Editorial Board for LexisPSL.

Vicky is recognised in Legal 500 as “an excellent lawyer” and “a great team player”.  She is also a Managing Intellectual Property Recommended Practitioner – recognised for her “helpful and calm” approach to difficult challenges, and a World Trademark Review Recommended Practitioner for Enforcement and Litigation.
